3. Account and Access

• All activity that occurs under your account

You retain ownership of the brand assets and content you provide to us for game creation. Games created through the platform are licensed to you under the terms of your subscription agreement.

6. Payment and Billing

Paid services are billed according to the pricing plan agreed upon at the time of subscription. All fees are non-refundable unless otherwise stated in your subscription agreement. We reserve the right to modify pricing with 30 days' notice.

7. Data and Analytics

Data collected through games created on our platform is governed by our Privacy Policy. You are responsible for ensuring that your use of player data complies with applicable data protection laws and for providing appropriate disclosures to end users.

8. Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Tingz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the services, regardless of the theory of liability.

You agree to indemnify and hold harmless Tingz, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the services or violation of these Terms.

11. Termination

Either party may terminate the service relationship at any time. We reserve the right to suspend or terminate access to the services if you violate these Terms. Upon termination, your right to use the platform ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New York County, New York.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the website or email. Continued use of the services after changes take effect constitutes acceptance of the revised Terms.
